    What rate do non-residents actually pay?

    Rental and imputed income are taxed at 19% for EU/EEA residents and 24% for everyone else — including UK residents after Brexit, who also lost the EU expense deductions on rental income.

    The capital gain when you sell is different: it is taxed at 19% for all non-residents, whatever your country. The "24% on the sale" you may read about online is a myth — we correct it for clients every week.

    Selling or buying from a non-resident?

    Form 211 — the 3% withholding

    When a non-resident sells a Spanish property, the buyer must usually withhold 3% of the purchase price and pay it to the Spanish Tax Agency using Form 211.

    If you are selling as a non-resident, we coordinate that withholding with your final Form 210 sale filing — including the refund claim when the withholding exceeds your actual tax.
